INTRODUCTION

Little Black Photo Booth’s website and digital service(s) are operated by Little Black Photo Booth Limited (2013).

1. Little Black Photo Booth is committed to fully complying with the New Zealand Privacy Act 2020 (the Act) when handling personal information (defined in the Act)
2. This Policy sets out how Little Black Photo Booth will collect, use, protect and disclose the personal information of any person who accesses our online services and makes a booking (the Host) with Little Black Photo Booth, or any guests of the Host’s at that booking.
3. This Policy does not exclude and/or limit any person’s legal rights under the Act. To see further information on the Act, visit https://privacy.org.nz.

 

CHANGES TO THIS POLICY

4. Little Black Photo Booth may replace, change or amend this Policy at any time at its entire sole discretion by uploading a revised Policy onto this web address without any warning. Any changes will apply immediately from the date that Little Black Photo Booth uploads the revised Policy and that date is located at the bottom of this webpage.

 

COLLECTION

5. Little Black Photo Booth’s sources for collection of personal information are:
   1. the Host directly when personal information is provided to Little Black Photo Booth in any way; 
   2. third parties where the Host has authorised this or if the information is publicly available.
6. Little Black Photo Booth will attempt to collect personal information solely from the Host directly, to the fullest possible extent.

 

USAGE

7. Little Black Photo Booth uses the Host’s personal information for the following purposes:
   1. Verification of the Host’s identity, contact details and address;
   2. Undertaking and providing our products and/or services to the Host and guests of the Host;
   3. for Little Black Photo Booth’s marketing (or its related entities’ marketing) of products and/or services to any person, including contacting the Host electronically (for example, by email or text);
   4. to effectively improve upon our products and/or services that Little Black Photo Booth (or its related entities) provides to the Host;
   5. to collect money owed to Little Black Photo Booth and bill the Host;
   6. to respond to communications from the Host;
   7. to enforce and/or protect the legal rights and interests of Little Black Photo Booth; including defending any claims; and
   8. for any other purpose that is authorised by the Host, or is permitted in the Act or any other law.

 

DISCLOSURE

8. Little Black Photo Booth may disclose the Host’s personal information to:
   1. another trading entity within the corporate group of Little Black Photo Booth;
   2. any business that supports services and/or products used by Little Black Photo Booth;
   3. Staff employed by Little Black Photo Booth, for the purpose of undertaking Little Black Photo Booth’s products and/or services to the Host;
   4. a person who may lawfully require Little Black Photo Booth to divulge the Host’s personal information (such as regulatory authorities, for example);
   5. any person authorised by the Act or any other law; and
   6. any other person authorised by the Host.
9. Little Black Photo Booth will only share or disclose the Host’s personal information to a person or entity overseas should Little Black Photo Booth be adequately satisfied that the Host’s personal information will be appropriately and securely protected.

 

STORAGE + PROTECTION

10. Little Black Photo Booth will make all reasonable efforts to appropriately protect the personal information that it holds effectively and securely from loss, misuse, unauthorised access, disclosure, alteration or destruction.
11. Little Black Photo Booth will only keep the Host’s personal information for as long as necessary for the purpose for which it was originally collected, or the purpose(s) for which it may be used.  For the majority of personal information held by Little Black Photo Booth, that will be for as long as Little Black Photo Booth has a relationship with the Host. Once Little Black Photo Booth’s relationship with the Host has come to an end, Little Black Photo Booth will only retain the personal information for a period of time that enables it to effectively maintain business records for the purposes of analysis and/or audits.
12. When personal information is no longer required for business purposes, (or where any other reason for deletion under the Act applies) Little Black Photo Booth will delete the Host’s personal information. If there is any information that Little Black Photo Booth is unsuccessful, for technical reasons, in deleting entirely from its systems, Little Black Photo Booth will put in place the appropriate measures to prevent any further processing or use of the data.

 

ACCESS + CORRECTIONS

13. Subject to the certain grounds for refusal set out in the Act, the Host (or any guest whose personal information is collected by Little Black Photo Booth) has the right to access their readily retrievable personal information that Little Black Photo Booth holds on them, and to request a correction to that personal information. Before acting on any such request, Little Black Photo Booth requires the supply of satisfactory evidence to confirm that the requester is the individual to whom the personal information relates.
14. In respect of a request for correction, if Little Black Photo Booth agrees that the proposed correction is reasonable and Little Black Photo Booth is reasonably able to change the personal information, Little Black Photo Booth will make the correction. If Little Black Photo Booth does not make the correction, Little Black Photo Booth will take reasonable steps to note on the personal information that the subject requested a correction.
15. If the Host (or guest of a host) wishes to exercise either of the above rights, the Host must email Little Black Photo Booth at info@littleblackphotobooth.co.nz. The Host’s (or guest of a host’s) email must include appropriate and satisfactory identifying evidence and set out fully the details of the request (e.g. the personal information, or the correction, that is being requested).
16. Little Black Photo Booth may charge for the reasonable costs of providing copies of any personal information or correcting that information.

 

INTERNET + THIRD PARTIES

17. While Little Black Photo Booth takes every reasonable step to maintain secure internet connections, any information provided to Little Black Photo Booth over the internet (that may or may not contain personal information) is done so at the user’s own risk.
18. If a user follows a link on Little Black Photo Booth’s website to another site, the owner of that site will have its own privacy policy relating to personal information. Little Black Photo Booth suggests reviewing that site’s privacy policy before providing any personal information. Little Black Photo Booth takes no responsibility for personal information that the user shares to a third-party site accessed via Little Black Photo Booth’s website, and cannot warrant the security of any website not published by Little Black Photo Booth.

 

ELECTRONIC MESSAGES

19. By using Little Black Photo Booth’s website or making contact with Little Black Photo Booth, the Host consents to receive communications of a commercial, promotional or marketing nature by email, electronic message, phone call, SMS or another communication method. The Host may opt out of receiving such electronic messages or other communications by contacting Little Black Photo Booth directly at info@littleblackphotobooth.co.nz or utilising any unsubscribe facility that accompanies an electronic message or other communication.

 

PRIVACY BREACHES

20. In the event of any privacy breach that is likely to cause serious harm, Little Black Photo Booth will notify the Office of the Privacy Commissioner and any affected persons in accordance with the Act.
